1. Definitions

1. Cookies are small data files deposited on user's computer or mobile device by the server of the website visited. They are used by a website to send information to the user's browser, enabling the browser to send information back to the originating site (such as a session identifier or language selection). This information can be stored for a given period of time, so that the user does not have to interact with it each time he or she consults the site or navigates from one page to another.

2. Other technologies with similar functionalities may also be used, particularly in environments that do not support cookies, such as mobile applications. The term “cookies” used in our “Cookies Policy” applies to all such technologies.

3. Only the sender of a cookie can read or modify the information contained in it.

4. There are different types of cookies:

  • session cookies, which disappear as soon as you leave the site;
  • permanent cookies, which remain on your terminal until their lifetime expires or until you delete them using your browser's functions.

5. You are informed that, when you visit PONANT website, cookies may be installed on the device you are using. Other third-party cookies may also be deposited to track you when you navigate to other sites using third-party components.

2. Which cookies do we use and for what purpose?

6. The categories of cookies used on the PONANT website and mobile application are as follows (for further details, please refer to the typologies defined in the “Cookie preference center” available at the bottom of the site page or in the “Legal information” of the mobile application):

  • Functional and security cookies: these cookies are strictly necessary for the proper functioning of the website and mobile application. They become active when you register or log in. They also enable us to use and improve the functionalities of the site and mobile application. They are implemented by PONANT and are kept for no more than 13 months from the time they are placed on the terminal. These cookies include an authentication cookie which recognizes your e-mail address once you have logged in to your account. It lasts for 7 days.
  • Personalization cookies: These cookies are used to adapt website content to your browsing habits and expectations. They enable us to provide you with unique experiences and contents by taking into account your habits on the website or app, the type of device you use and much more.
  • Cookies for audience measurement, performance and content improvement: these cookies enable us to carry out statistical studies on website and app traffic, in order to measure and improve performance, content and services. They also enable us to evaluate advertising performance (number of clicks, conversion after viewing an ad, etc.). These cookies enable PONANT to understand the use made of the website and application by Internet users and to better meet their expectations. They are kept for a maximum of 14 months from the date they are placed on the terminal.
  • Advertising or retargeting cookies: these are used to tailor advertisements to users. PONANT uses the information collected through these cookies to personalize website content, banners or promotional offers from PONANT on the website and on other websites you visit. Rejecting these cookies will not stop advertising on our website or on other sites you visit. Advertisements will simply no longer be personalized and may therefore be less interesting for you and more repetitive.
  • Social network cookies: these enable content to be shared directly on social networks from the site. They are deposited by the publishers of networks such as Youtube. We have no control over how long these cookies are kept.

3. Consent

When you access our website, you are offered the opportunity to express your choices regarding the deposit of certain cookies by setting the parameters of the cookie banner that appears on your first visit to the site, and at any time as indicated in the following section entitled “Cookie management”.

If you do not wish cookies to be installed or read on your terminal equipment, a refusal cookie will be deposited on your equipment, so that PONANT can record the information that you have objected to the use of cookies. If you delete this refusal cookie, it will no longer be possible to identify you as having refused the use of cookies.

Please note that if you refuse to accept cookies that are necessary for the operation of our sites and applications, or if you delete the cookies stored on your terminal, you will no longer be able to benefit from certain functions that are necessary for optimal browsing of our sites and applications (for example, cookies that enable us to recognize the type of browser used by your terminal, its language and display settings, or the country from which your terminal appears to be connected to the Internet). Where applicable, we decline all responsibility for the consequences linked to the degraded operation of our services resulting from our inability to record or consult the cookies necessary for the proper operation of our services.

10. Similarly, when you accept the use of cookies, a consent cookie is installed.

11. Consent or refusal cookies must remain on your terminal equipment. You can also configure your browser at any time, as described in the next section, “Cookie management”.

4. Cookies management

12. You have several options for deleting and managing cookies and other trackers.

4.1 Consent management platform

13. A module allows you to choose which cookies you wish to accept and which you wish to reject on this site.

14. At any time, by clicking on the banner that appears at the bottom of your browser window entitled “Cookie Preference Center”, you can access the module and modify your preferences.

4.2 Browser settings

15. Although most browsers are set to accept cookies by default, you can choose to accept all cookies, reject them systematically, or select the cookies you accept according to the sender. You can also regularly delete cookies from your terminal via your browser.

16. However, don't forget to set the parameters of all the browsers on your various terminals (tablets, smartphones, computers...).

18. To disable cookies from an iOS terminal, you can activate the “Limited ad tracking” option.

19. To disable cookies from an Android terminal, you can activate the “Disable ad serving by centers of interest” option.

4.4 Publisher opt-out modules

20. Finally, you can choose to deactivate certain third-party cookies, by going directly to the Publisher's page. For example :

  • To deactivate Google Analytics cookies, go to this site;
  • To express your choices directly through the inter-professional platforms, you can connect to the site. This site is proposed by digital advertising professionals grouped together within the European Digital Advertising Alliance (EDAA). This European platform brings together hundreds of Internet advertising professionals and provides a centralized interface enabling you to express your refusal or acceptance of cookies. Please note that this procedure will not prevent the display of advertisements on the websites you visit. It will only block technologies that allow us to adapt advertising to your centers of interest.

5. PONANT's commitments regarding Cookies

21. PONANT is committed to protecting your privacy. Cookies do not allow us to know your address, date of birth or telephone number.

6. Personal data protection

22. In connection with the use of cookies as described in this document, PONANT may process personal data about you, as the data controller.

23. The data collected is necessary to achieve the objectives pursued by each cookie. It is intended solely for the authorized departments of PONANT and/or the company issuing third-party cookies.

24. Personal data collected via cookies is never kept longer than necessary to achieve the purpose of the cookie.

25. Pursuant to the provisions of the General Data Protection Regulation (“GDPR”), individuals have, within the limits of compliance with their legal obligations, a right of inquiry, access, rectification, erasure, opposition on legitimate grounds, limitation of processing and portability in relation to all data.

26. You have the right to define specific post-mortem directives concerning the conservation, deletion and communication of your personal data.
